Welcome to Acquiesce&. The terms “we”, “us” and “our” refer to Acquiesce& (the “Store”).

We operate this website and online store, including all related information, content, features, tools, products and services (together, the “Services”) to provide you with a curated shopping experience. Our store is hosted on Shopify Inc. (“Shopify”), which provides the ecommerce platform that enables us to sell products and provide the Services.

These Terms of Service (“Terms”), together with any policies referenced in them, set out your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights and cover areas such as limitations of liability.

By visiting, browsing, interacting with, or purchasing from our Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, you must not use the Services.


1. Access and eligibility

To use the Services and place an order, you must be at least 18 years old or have permission of a parent or guardian.

You may be asked to provide information such as your email address, billing, payment, and delivery details. You confirm that all information you provide is accurate, current, and complete, and that you are authorised to use the payment method provided.

If you create an account, you are responsible for keeping your login details secure and for all activity under your account. You must not transfer or assign your account to another person.


2. Products and product information

We aim to present products as accurately as possible. However:

  • colours and appearance may vary between screens and printed products due to device settings and production differences

  • product images are for illustrative purposes and may not reflect exact colour or finish

Product descriptions, pricing, and availability may be updated from time to time. We may discontinue a product or limit quantities at our discretion where permitted by law.

Nothing in these Terms affects your statutory rights under UK consumer law.


3. Made to order production

Our journals are made to order. This means production begins after an order is placed and payment is received.

Production timeframes are explained on our Store Information page [LINK] and may take up to 10 working days before dispatch.


4. Orders

When you place an order, you are making an offer to purchase products from us. We will confirm acceptance of your order by email. A contract between you and us is formed when we accept your order.

We may refuse or cancel an order in limited circumstances, for example if:

  • the product is unexpectedly unavailable

  • we suspect fraud or unauthorised activity

  • there is an error in pricing or product information

If we cancel an order, we will refund any amounts paid for the cancelled item(s).

Your purchases are subject to our Returns and Refunds Policy [LINK].

Orders are for personal use only. You must not purchase for commercial resale.


5. Prices, payment, and promotions

Prices are shown in GBP (£) unless stated otherwise. Delivery charges are shown at checkout.

We may run promotions from time to time. Any additional terms for a promotion will apply as stated. If promotion terms conflict with these Terms, the promotion terms will apply.

You agree to provide valid payment information and authorise us (via Shopify and payment providers) to charge the total amount at checkout, including any delivery charges and applicable taxes.


6. Delivery and dispatch

Dispatch occurs after production is complete. Delivery estimates are provided at checkout or in order communications and are not guaranteed.

We are not responsible for delays outside our control, including delays caused by carriers, customs, or events such as severe weather.

Risk in the goods passes to you when you, or a person you nominate, takes physical possession of the goods. If you choose your own carrier and that option is not offered by us, risk may pass to you when the goods are handed to that carrier.


7. Cancellations and returns

Your cancellation rights and eligibility for returns are set out in our Returns and Refunds Policy [LINK].

If products are made to order or personalised, the usual 14 day cancellation right may not apply once production has started, as explained in the policy. Your statutory rights relating to faulty or misdescribed goods are not affected.


8. Intellectual property

All content on the Services, including trademarks, branding, text, images, graphics, and design, is owned by or licensed to Acquiesce& and is protected by applicable intellectual property laws.

You may use the Services for personal, non commercial purposes only. You must not copy, reproduce, distribute, modify, or exploit any part of the Services without our prior written consent.


9. Optional tools and third party services

We may provide access to tools or services offered by third parties. These are provided “as is” and “as available”. We do not control third party tools and are not responsible for them.

Your use of third party services is at your own risk and subject to the third party’s terms and policies.


10. Third party links

The Services may contain links to third party websites. We are not responsible for the content, accuracy, or practices of third party sites. Accessing third party sites is at your own risk.


11. Relationship with Shopify

Acquiesce& is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Acquiesce&. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Acquiesce&, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Acquiesce&.


12. Privacy

Our Privacy Policy explains how we collect and use personal data: [LINK]. Shopify may also process your data to provide the Services. By using the Services, you acknowledge that you have read our Privacy Policy.


13. Reviews and feedback

If you submit reviews, comments, or other content (“Feedback”), you grant us permission to use it to operate, improve, and promote the Services, including displaying it on our site and marketing channels.

You confirm that your Feedback is accurate, lawful, and does not infringe third party rights. We may remove Feedback that we believe breaches these Terms or applicable law.


14. Errors and corrections

Occasionally there may be errors in product descriptions, pricing, promotions, or availability. We may correct errors and update information at any time. If an error affects an order, we will contact you and provide options, including cancellation and refund where appropriate.


15. Prohibited uses

You must not use the Services in any way that is unlawful, harmful, or interferes with the operation or security of the Services, including attempting to access data not intended for you, introducing malicious code, scraping, or misusing the site.

We may suspend or terminate access to the Services if we reasonably believe you have breached these Terms.


16. Disclaimer and limitation of liability

Nothing in these Terms limits or excludes liability for:

  • death or personal injury caused by negligence

  • fraud or fraudulent misrepresentation

  • any other liability that cannot be limited under applicable law

Subject to the above, we are not liable for losses that were not foreseeable at the time of contract, or for business losses where you are purchasing as a consumer.

We do not guarantee that the Services will be uninterrupted or error free.


17. Indemnity

If you breach these Terms or misuse the Services in a way that causes loss to us or a third party, you agree to compensate us for reasonable losses arising from that breach, to the extent permitted by law.


18. Severability

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain in full force.


19. Entire agreement

These Terms and the policies referenced in them constitute the entire agreement between you and us in relation to your use of the Services and purchases from the Store.


20. Changes to these Terms

We may update these Terms from time to time. Any changes will be posted on this page and will apply from the date they are published.


21. Governing law

These Terms are governed by the laws of England and Wales. If you are a consumer, you may also benefit from mandatory protections under the laws of your country of residence where applicable.

Any disputes will be subject to the jurisdiction of the courts of England and Wales, without limiting consumer rights to bring claims in their local courts where applicable.
